1. Purchasing a Fire Suit
a. Quotations
i. All quotations exclude GST, are in New Zealand dollars and are ex works unless otherwise noted.
ii. Fire suit quotations are structured as a base model and additional optional extras, which are charged each in addition.
iii. Quotations are valid for 30 days from the noted quotation date.
iv. Price Hold enables the buyer to get the advantage of volume pricing and cater for single orders that might follow. It is available for orders with Lifetime Care, and orders can be placed for any volume, with a delivery and payment split over up to six months from the initial order at the same volume price.
v. Price Hold is only available against a confirmed purchase order number for the full volume.
vi. Price Hold orders can be cancelled with a 20% penalty of the value of the full order, where the cancellation is accepted by Styx Mill and the goods have not commenced manufacturing.
vii. Price Hold is for each volume order and case by case, there is no default rollover to the next volume purchase.
viii. All quotations are confidential between the buyer and Styx Mill.
b. Fire Suit Measuring
i. Styx Mill has a preference to use sizing garments for measuring. From measuring to delivery, it is the buyer’s responsibility to advise of weight changes up or down exceeding 2kg, and cover the costs to cancel or change the manufacturing process.
ii. Sizing garments remain the property of Styx Mill. It is the buyer’s responsibility to decide what the layer of garments are under the fire suit, and keep this consistent as not to affect sizing.
iii. Jackets and trousers can have the arm or leg length customised. Styx Mill reserves the right to do this customisation as an alteration rather than making a new suit.
iv. It is expected that the person being measured remains respectfully clothed. The person measur-ing might respectfully physically touch the wearer as part of the measuring process. It is expected the wearer advises any specific requirements they have around the measuring process.
c. Delivery & Perfect Fit
i. No delivery timeframe offered by Styx Mill is confirmed until acknowledgement is made of the buyers order. Where custom garments are being made, the delivery date will be confirmed once the design or samples have been signed off by the buyer.
ii. Notification of suit orders for future dates is no guarantee of delivery timeframes until a confirmed order is acknowledged. Any order could be delayed due to supply chain and other reasons and the buyer accepts this. Styx Mill will advise full or part delivery dates on confirmation of order and reserves the right not to deliver in full to the buyer.
iii. It is the buyer’s responsibility to notify Styx Mill within 7 days of delivery if the suit is not a suitable fit.
iv. Styx Mill guarantees a perfect fit and will adjust or exchange the garment where notified in this time-frame. The suit will not be exchanged if it is not in perfect saleable condition, or the garment adjusted if it has been used, and not washed at the buyer’s expense.
v. Styx Mill only guarantees perfect fit where the garments have been measured by Styx Mill em-ployees, or the process has been part of a video call.
d. Non Fire Suit Styx Mill Products
i. Styx Mill fire suit buyers have access to other lines in the Styx Mill product range, at discounted pricing. This includes safety, oilskin and other non-fire suit fire products. 2 | P a g e Styx Mill Fire Suit Terms & Conditions V1.5
2. Warranty Types
a. Fire Suit General Manufacturer’s Warranty
i. The general warranty covers 36 months from the manufacture date of the garment or 36 garment piece washes, whichever comes first. It is only available for new product, not second hand suits.
ii. The general warranty covers faulty materials or workmanship in manufacturing or construction under standard consumer obligations.
iii. As part of the warranty, it is the buyer’s responsibility to maintain the wash records for each gar-ment, or be able to provide a garment wash history on request.
iv. Styx Mill’s liability is limited to the repair and replacement of the defective product or the refund of its purchase price. The warranty is void with any of the following circumstances.
1. The garment hasn’t been inspected on schedule by Styx Mill, and the certification date has expired, as seen on the garment care label.
2. The warranty claim relates to normal wear and tear.
3. The garment was misused, neglected, damaged, abused or involved in an accident.
4. The garment was used for a purpose for which it was not designed nor intended.
5. The garment was improperly cared for, cleaned, repaired or maintained.
6. The garment was altered or modified.
7. The owner or user of the garment did not follow any warnings, safety instructions, mainte-nance instructions and care and use instructions.
- Styx Mill reserves the right to improve its Products through changes in design or materials with-out being obligated to purchasers of previously manufactured Products.
b. Fire Suit Lifetime Care Warranty
i. Lifetime Care is in addition to all the fire suit warranty benefits for Styx Mill fire suits.
ii. Included in Lifetime Care are Inspections, a complimentary 24-month re-certification manufac-turer’s, fuel and chemical contamination garment inspection. Repairs, totally free non-warranty repairs including panel reconstruction, and Trade Backs, access to the “trade in” program for Styx Mill suits that are no longer required by the buyer.
iii. The Lifetime Care warranty is non-transferable, and the price is per piece (jacket or trouser) per year, for the time period. It is non-refundable if the suits are traded back to Styx Mill.
iv. The Lifetime Care warranty is only valid for the timeframe of the General fire suit garment war-ranty.
v. Lifetime Care beyond the initial 36 months, up to 60 months, may vary and will be quoted on application.
vi. Lifetime Care on any item is invalid if the buyer has an overdue credit balance with Styx Mill.
c. Out of Warranty Support
i. Out of warranty repairs are charged by hours and materials, plus GST. The Buyer is responsible for shipping the garment to Styx Mill.
3. Garment Management
a. Fire Suit Trade Backs
i. The trade in / recycling offer as part of the lifetime support is subject to availability from the Seller. The final value will be made as an offer by the Seller to the buyer.
ii. The pricing valuation for trades generally follows a sliding scale, subject to garment condition and a manufacturer assessment. The price does not include extras like braces, labels, badges, freight or Lifetime Care costs. 3 | P a g e Styx Mill Fire Suit Terms & Conditions V1.5
- Panel not Patch. Wherever possible Styx Mill will attempt to do repairs by panel rather than a garment patch. Sometimes this might not be realistic, and Styx Mill reserves the right to decide on this. Sometimes repair fabrics might be a different shade or colour tone due to the age of the garment. Styx Mill reserves the right not to repair a garment.
- Reproofing the garments may be required after 20 washes and this is part of the cleaning pro-cess. Reproofing is the buyer’s responsibility and falls outside of warranty.
